Legal Drama Unfolds as Criminal Case Against Nana Yaw Fianko III & 9 Others is Withdrawn Without Victims’ Knowledge

In an unexpected legal twist, the criminal case The Republic versus Nana Yaw Fianko III & 9 Others, previously pending before the Nsawam Circuit Court under Case Number 89/10/23, has been officially struck out as withdrawn. This development was confirmed in a response dated February 12, 2025, and signed by the Registrar of the Circuit Court.

Case Background

The case arose from a violent incident on May 9, 2023, at Nokoyedzen-Larteiman, within the Nsawam-Adoagyiri Municipality. The confrontation reportedly erupted during a community event organized by the complainants and escalated into violence involving the alleged use of offensive weapons. Several individuals sustained injuries, and property damage was estimated at over GHC 18,000.

The accused included traditional leaders and residents from Chinto Traditional Area, Lantei, and Ahiabu. Following police investigations by the Nsawam District Police Command, the matter proceeded to the Circuit Court for prosecution.

Controversial Withdrawal and Public Outcry

Shock and dismay swept through the local community upon learning that the case had been withdrawn without prior notice to the victims. Legal representatives of the victims raised concerns that the decision contradicted an earlier recommendation from the Attorney General’s Office in Koforidua. Describing the move as “deeply troubling,” they questioned the integrity of the legal process and its commitment to justice.

Legal Team’s Response and Appeal

The victims’ legal team, led by Joseph Wellington Bowuah Blay, Barrister and Solicitor of the Supreme Court of Ghana (Licence No. EGAR 03584/25), has formally petitioned the Attorney General’s Office to review the case and ensure justice is upheld.

> “Our clients were never informed of the decision to withdraw the case, and they deserve a fair hearing. We expect a transparent and impartial review that respects their rights,” stated Mr. Blay.

Current Status

As of now, no further court proceedings are scheduled. The public is hereby informed of the official withdrawal of the case, as documented by the Nsawam Circuit Court Registry.
